DUI & Traffic Matters

A DUI conviction in Colorado means license suspension, fines, possible jail time, increased insurance rates, and a permanent criminal record. The process moves quickly, and there is a hard deadline to protect your driving privileges that most people do not know about until it is too late. The attorneys at Fredrickson Johnson and Terry handle DUI and traffic matters in Canon City, Pueblo, and throughout southern Colorado.

In Colorado, you have seven days from the date of your DUI arrest to request a DMV Express Consent Hearing. If you miss that deadline, your license is automatically revoked regardless of what happens in criminal court. The DMV proceeding is separate from your criminal case and requires immediate action. Contact us as soon as possible after a DUI arrest in Fremont or Pueblo County.

A DUI arrest does not automatically produce a conviction. We examine whether the traffic stop was lawful, whether field sobriety tests were properly administered, whether the breathalyzer was correctly calibrated and operated, and whether the blood draw followed Colorado's required procedures. Many DUI cases have defensible issues that only become visible through a thorough review of the evidence and police reports.

What is the difference between a DUI and a DWAI in Colorado?

DUI applies when a driver is substantially incapable of safely operating a vehicle due to alcohol or drugs, with a blood alcohol content of 0.08 or higher creating a legal presumption of DUI. DWAI is a lesser offense for a BAC between 0.05 and 0.08, or when ability is impaired to the slightest degree. DWAI still carries fines, points, and potential jail time. It is not a minor citation.

Will I lose my license after a DUI arrest in Colorado?

License revocation is a civil process handled by the DMV separately from your criminal case. If you do not request a DMV Express Consent Hearing within seven days of your arrest, revocation is automatic. Even if you prevail at the DMV hearing, your license may still be affected by the outcome of your criminal case. An attorney can handle both proceedings simultaneously to protect your driving privileges.

Can a DUI charge be reduced or dismissed in Colorado?

In some cases, yes. DUI charges can be reduced to DWAI or reckless driving through negotiation, and can be dismissed entirely when there are constitutional violations or evidentiary problems with the prosecution's case. Whether reduction or dismissal is realistic depends on the specific facts of the arrest. There is no universal answer without reviewing the evidence and the circumstances of the stop.
